    Even if the lady didn't spill it on herself, according to McDonald's own testimony -- it was too hot to drink. It would burn the throat and mouth.
    Okay, who the hell is going to take a fresh cup of coffee (which you can tell is extremely hot by holding the cup) and just dump it down their throat? An idiot, that's who.

    McDs had no reason to keep it's coffee temperature
    20 degrees above the industry standard. 'Standard.'
    That's what most people expect when they get
    coffee. If they spill something on themselves (which
    everybody does, and I don't believe you people when
    you say you're too smart to spill), they dont'
    expect anything more than a little mess. Not
    $20,000 worth of medical bills.
    As was stated previously, they kept the coffee at this temperature to retain the taste. I didn't say I was too smart to spill, I implied I was too smart to screw around with scalding hot coffee. I've spilled milk, juice, all kinds of stuff... but you should be at a higher level of conciousness when handling dangerous goods.

    Again, I say should, because I cannot comprehend what an idiot is capable of.

    On a side note, going along with the lawn mower theme... does anyone remember the man who tried to mow his lawn in the snow, only to have his lawn mower explode and burn 90% of his body?

    Now I'm not saying I'm too smart/talented to spill something on myself, I'm just saying that if I did so, it would be entirely my fault. Every day we deal with things that are potentially dangerous. All the time. Where will it end? Will we all be walking around in padded rooms with padded floors eating with our hands out of soft plastic contains to large to swallow and choke on?

    I do house renovations. I work with a lot of tools. When I buy a hammer, I expect it to be hard. I like it that way. It works better. However, if I drop it on my bare foot, its gonna hurt. I should have been wearing steeltoes. My skillsaw is sharp. It works better when its sharp. But you do realise that I could easily chop things off with it. Do I want the manufacturers to produce blunt skillsaws? Not particularly. That would make my job just a little harder.

    The idea is that you use your brain (just a small particle of it will work in most situations) to assess the things around you. It seems everyone wants to be coddled their entire lives; Never having to think for themselves. It makes me sick. Stop trying to blame somebody else. Grow up and own up.

    I don't think this MD's v Burnt Old Lady is a good example. I think MD's did contribute to the accident.

    Most accidents are not 100% the fault of one party. Sometimes it takes a concerted team effort for idiots to screw up properly.

    I have spilt coffee on my self. I did not have to spend a week in hospital having skin grafts.

    MD's knew the coffee was TOO hot, as they have about 1.5 people burn themselves a week.

    They knew people wanted it cooler, according to their own market research.

    They kept it TOO hot to save money (as it retained the taste longer if they did so).

    They could have taken responsibility and paid half the medical bills (even as goodwill / customer relations), or settled at mediation but decided to take the chance and lost.

    A good example is;

    Lady goes to a party at pub. Drinks too much and is refused service, offered a lift home in pub bus or a taxi, refuses and abuses bar staff. Leaves on foot. Tries to cross road and gets run over, by person traveling within speed limit.

    Judge awards nearly Au$500K againt pub and driver. Thankfully we are reasonably sane here and is over turned on appeal.

    If you take drugs (including alchol) and do something stupid or illegal, it is not the drugs fault, it is totally your fault. We have let lawyers convince us (and the courts) that we are all victims and we have no personal responsibility.

    This is why I drink Frappucino. No one ever got burned by a 40 degree (F) caramel mocha drink spilling in their laps! You never hear about people careening off the road as a Slurpee severly scalds them, do you? No! Prohibit hot beverages!

    Unfortunatly not so sane in the States. A woman goes to an office christmas party. Open bar and everything is free. She has some drinks. I believe there was even a shuttle service provided free of charge but she decides to drive home. Gets in an accident... And then sues here employer for letting her drive!!! She wins (partially).

    Well, the thing here is that you cannot be 100 % sure what the judge thinks when making a decision. But even if the coffee was dangerously hot the lady knew that MD did not sell it to her for spilling it on herself!

    McD's shouldn't have served coffee at or near boiling is the point. Take Ken's electricity analogy. It's ok as presented, but what if the power company decided to save $ by not adding transformers to step the voltage down before it got to his house. Now, assuming the house doesn't burn down first, Ken plugs in his Dell and whamo! Kentucky Fried Ken. Heck, everyone knows, or should, that electrity is dangerous. Should you hand Ken the idiot sign, or does the power company have some responsibility here?

    Most of you people need become less-obsessed with

    I on the other hand do not; I think its farcial that MDs be sued because someone spilt coffee over themselves. It was about as hot as people's coffee at home, atleast most people i know tend to BOIL the kettle then pour the water into the coffee mug = boiling hot coffee.

    So basically MDs was sued for having coffee as hot as most people have it at home........LAME.

    Jeez, get a Coffee Maker, Amishboy.

    They let it cool down. They know it's hot. When
    you buy something at a resturaunt, it's suppose
    to be ready to consume. That's the whole point
    of the resturaunt business. You're not suppose
    to order your food, then wait 10 minutes for it
    to cool down. You buy it, then eat (or drink) it.

    Fast Food, duh...

    Alot of people LIKE their coffee hot, in-fact several of my friends prefered MDs coffee the way it was (no they didn't gulp it down, presumeably they sipped it).

    Besides that is irrelevant, whether or not the coffee is to hot to drink immediately, is not the point, MDs were sued for serving a dangerous product, when in fact it's no more dangerous than the coffee i and many other people make at home!

    Absurd.

    If I spilled coffee on myself I'd expect to be injured. But to get 3rd degree burns and spend the week in the hospital? Come on!

    If I spilled that kind of coffee on my groin, I'd sue them also.

    Funny, in almost every single post you make it a point to insult someone. Either a kettle or a coffee maker, the water still gets boiled... so what is the difference?

    No, it's not. Infact, it's not supposed to be anything. If I order something hot off the grill (oven, broiler, whatever) I expect to have to wait before eating it. I'm not going to complain that my food is too hot, i'm going to complain if they take too long getting it to me. Let me decide when it's cool enough to eat.

    Oh, really? When did you become the expert on this? I'd expect these "facts" to vary from place to place (restaurant to restaurant)
