Contract anyone?
I am selling my computer to a freind of a friend this weekend, and since it is watercooled and such i want to write up a contract waiving me of responsibility and such if it leaks or yadda yadda after i sell it.
I know it'll be something like "I agree to pay (name) in the amount of (amount) for the purchase of this computer on the day of (date). I further agree that all responsibility regarding the said computer is mine, as the purchaser, and mine alone....etc"
Ive never written a contract, and would like some suggestions as to what to include.

It doesn't really matter what it says as long as you come to an agreement as to who is responsible for what. As long as it's signed by both parties, nothing else is to be done. You don't have to be super fancy about it, but make sure you think of everything you want your ass covered for.

If you're just a little paranoid, you can try to get a couple independent witnesses to sign as well (or maybe one friend of yours, and one friend of his). The two main parties should sign at the same time, the witnesses should be there to... well... "witness" the signing by the both of you and will be able to testify to that fact should thing come into dispute. Everybody should include the date and time they signed.
If you're not that concerned, then what you have already is probably fine.

Ok, im not to worried hes already accepted the price and responsibility of water cooling yadda yadda. Just wanna make sure should he decided its too much effort for him to maintain he doesnt come seeking his 1,000.00 back lol.
-
If you were to insist on bringing in witnesses, I'd imagine he'd become a bit suspicious...
-
Just mark it as 'as-is' so like a used car you get what you get and that's all there is to it.
-
Just create a standard bill of sale.
[quanity] [object] sold to [buyer's name] for the amount of [amount] as is with no warrenty or guartnee given.
Of course make sure you spell it correctly since I know I can't :)
-
make sure its typed and you get copies of it, but you should
get the original notirezed with the other person.
-
Ok, thnx alot guys. I also told him i'd give him copies of all of my reciepts and such.
-
if you want real protection, make them get it notorized.
as for "it's yours, not mine - so you pay for it" - its called an indemnification clause (aka hold harmless agreement) they usually go - " (by signing below) I, herby agree and affirm to indemnify <insert your name here> ......"

This thread wasnt closed, and im in a position like RoD's but a little different. I'm not scared of a "warranty" i just want to make sure i get paid. Any ideas for a contract like that? its weird though because im getting a flat fee and then a profit share. Any ideas appreciated

Um...make them give you the money before you give them the computer, just like anywhere else...
-
its not a computer.... how could a computer generate profits.... hmmm
edit: i guess i wasnt clear enough. Im not selling a computer, a service. I should just get his address, that way if he doesnt pay, I'll kill him ::evil laugh::
-
orr... you could make him pay up front!? Then you have to deliver.

I am getting paid up front, a flat fee. Then 30% profit.
