O'Conner's resignation is worded so that she will continue to serve until she is replaced. By having Roberts replace Rehnquist, you don't replace O'Conner, and therefore, the court stays full.
Roberts will not replace Rehnquist -- O'Conner will. Roberts will be just filling a vacant chair.
