Adrian, I don't think it can legally be asked. I know I've never gotten that question either (and don't know who actually has gotten it). Truly, I think it was a joke with no seriousness intended.
There is one exception though. If you are in the military and are admittedly gay, you are discharged. However, if you are gay and don't say anything about it, it's fine.
legally they COULD ask, but its in their best interest not too. Lets make an example, i go in for an interview and they dont ask, i dont get the job. Bob goes in for an interview and they ask and he tells them hes gay. Bob doesnt get the job either. Guess who's going to sue on a disciminatory claim?
