I love alerting ISPs to little skript kiddies..this one person in france or spain (I can't remember) constantly scans my IP range...I can't tell you the amount of times I've reported him.

Yeah, but it is often mentioned in the Terms and Conditions of signing up to the service. There may be no stautory offence (not too sure of legality on this matter), but if you break the terms they can withdraw your access to their service. Whether they do actually enforce this is another matter

Road runner certainly does do something about it.
I recieved a nasty letter from them for some port scanning that I did. I was doing it to find out more about a computer that was hitting me. It was a Unix server and it was wide open.
I telnetted in and got the POC name/email and emailed him. I told him that I was having problems with someone launching attacks from his box. Well he aparently went to his logs and got my information and blamed me as the culprit to my isp.
That sucked. Two strikes and you are out with roadrunner.
The thing that sucks about it for this guy is that it is a cable modem. In my area, road runner is the only cable modem provider as it probably is the same for him. So... you certainly can win. Once you lose cable modem service... you lose it. Then you are stuck with dial-up.
Plus, if it is some kid... his parents will certainly not like receiving a nasty-gram that their computer is violating rr terms and conditions. (note: in the terms and conditions the user is responsible for a secure computer. If you are hacked and someone hacks from your box, you lose your service.)
