    Legal Advice (more like question)

The other day I was in a store using this free internet kiosk thingy (I go there quite often to use it). As I was leaving (I was already out the door) this guy aproaches me and is like "My name is xxxxx with store security, what did you do with the xxxxx" so I tell him I put them back and he asks me to come back in the store and him and like 5 guys fscking question and search me (finding nothing)!!! Im just wondering, could I have legally told him to .......... off (not let him search me), and would the case be the same if I was still in the store when he stopped me.

AFAIK, they can only approach you once you leave the store, but I wouldn't have told him to .......... off anyways.
Naturally I didn't feel inspired enough to read all the links for you, since I already slaved away for long hours under a blistering sun pressing the search button after typing four whole words! - Quzah

Take a breath and tell the story so it makes some sense.

Thats all there is to the story, I was thining about buying some garden seeds but decided not to so I just threw them in some box in the store. When I led them to where I thought I put them they werent there.

Im wondering if I could have legally just walked away.

    Huh? Make sense much?

Anyway, there's only one state where cursing is a punishable offense (AFAIK), so tell people to fsck off all you want.

Well, in UK if that happened to me-I would be suing for assault.

Only the police are allowed to search a citizen. Did they search you or did you empty your pockets and drop your trousers etc? If they touched you even ONCE-you have them by the balls. (in a manner of speaking)

Blimey in USA you sue for anything dont you.....

You can have them for wrongful arrest-as you have to be arrested by store security to be brought back inside (they wont tell you that though) -they do have the power of citizens arrest, but they MUST be willing to accept the consequences if they made a mistake (like in your case)

You also have a charge of being detained against your will-I gather they would not let you go until they were happy?

Dont take crap like this from anyone-exercise your rights!

    Oh damn-I forgot----

You asked if this happened in the store would it have been different.......

Yes indeed-you cannot legally have stolen anything until you leave the store..you may be eccentric and (for example) decide to not use a basket as they are too heavy....

...instead you may be carrying around in your pocket!

    Sounds daft, but is true.

First of all, I'm assuming you're in the U.S. If so, even a police officer wouldn't have the right to search you unless you consent to it, he has a warrant, or you are under arrest. So, if a police officer ever asks to search something, say no! Always remember that you have the right to refuse a search. You could've told that guy that you didn't want to be searched, and then, he couldn't have searched you.
