    Before this thread dies off, I wanted to ask this:

    If YOU spilled that coffee on yourself inder the same circumstances, yadi yada, whould YOU sue (given a good chance of winning)? After the person has already spilled the coffee, it's either they pay for it, or sue and someone else does... which one is the better choice?

    We know "the system" is messed up, but this is a fact we cannot go around... some might say those 'idiots' who sue only use it to their advantage... To SUE or NOT to SUE...

    Wow, amzing if I made cofee or tea at home then I would need surgery if I spilled it on my self. How much her medical expenses where does not matter. The cup should have been in a cup holder, and the chance that her car does not have any she could have asked for one.

    add cream/sugar when it's in a cup holder. You
    need to remove the lid to do that.

    Hmmm. If it put me in hospital for a week and did US$20,000 of damage. Otherwise no.

    I have spilled boiling liquids on myself, touched hot pans ect. Never had skin grafts. (I already have a sign, and the note to remember to wear it, and a rubber stamp for the beach)

    I believe that MD's were stupid here. They expected her to go away when they did not pay. Their lawyers should have told them the risks and advised settlement (seeing they have so many complaints about the coffee temp, and have since changed it). She only wanted half the medical bills (ie she admitted half responsibility). Think how much it cost her to get MD's to court. (easy US$50,000 prob more like US$150,000)

    That is why the payouts are getting so large. Juries are penalising large companies for dragging these case to court whan they should have been settled early. Justice is not for those who can not afford it, look at OJ.

    Remember, if you commited the crime, get the jury as you will have nearly twice the chance of aquittal.
    If you did not do it, go for the judge only.

    That wouldn't work in the states - signing your driver's license is complying to give a breath test whenever requested. Otherwise, they can arrest you.

    Yes, see this is because of the stupid dog woman. Now they have to put these incredibly obvious warnings on everything. But I'm thinking... It says no pets, but what if I need to dry my hair really quickly? hmm....

    Dito here. If you read the small print you'll also realise that you dont actually own either your drivers license or your insurance. They're both property of some govornment organisation (in my case ICBC). It says that you must surrend possesion of it upon request. I suppose if you refuse to give it up then your stealing.

    Sure, I can say I hate my job but I need to side with them. Odd.

    Second I have yet to see a cup holder that makes it so you can't remove the top. The cup sits in the cup holder.

    Ok she took of the lid off well it was between her legs? LMAO That is increadibly stupid. The cup is styrophome and can easily be punctured. Second when you remove the lid some it is very easy to to tip if you don't hold the cup.

    No I would not.

    I know this isn't quite the same but:
    Let's say you ended up in the hospital because of food poisoning from your friend's cooking would you sue him?
    Or would you be more likely to sue if it were food from MDs?

    Well the food is cheaked the goverment so in that department there to blame. IF the food is undercooked, then the Mcdonalds you got it at is responsible (not the entire corporation) as you see you put the burgers on the grill and close a cover over them. The cover raises automaticly. The only way to under cook the food is if you were to hit the button and have the cover come off early.

    Ok, say the lady is an idiot and McD shouldn't be responsible. However, I'm sure their arsenal of lawyers know what a stupidly litigous society we're in, and the massive and absurd verdicts that come down.
    Couple this with the rest of the facts (McD knew coffee was too hot, etc), and who's the idiot for not settling for half the medical bills?
