Free midi files?

Are there any sites I could find some midi files? Perferably background like music? Any type for now.

But... the best site I would like (if one exists) is one with unlisenced music, so if it were in a game (profit), one would not be sued :)

There are thousands of MIDI files all over the place. I have quite a few myself.

Several of them are background music. Some are not. Pretty much any MIDI file is downloadable for free.
