Well, the two seem to be legally distinct. I don't think Apple has a case. I hope this is some sort of weird publicity stunt.

Google should sue too. Let's get on the NY Logo bandwagon!

I reckon apple are just looking for some extra cash from an out of court settlement. If anything, any confusion that would result from this would actually be good for Apple. Since the NY logo is not even a product I doubt Apple's design registraton would hold much weight here

It's pretty odd actually, not only is it a ridiculous law suit, but it goes against apple's approach of "being cool". Suing New York over an apple isn't "cool".

The problem apparently is that it is being used on some of the same items apples places its logo on... mugs, pens and such

Maybe they can use the cash to subsidise the cost of their overpriced proprietary machines (some people call them computers).

First let me state that I dont like Apple for a lot of reasons, some good, some bad, some indifferent, none of which I will go into here. The same goes for New York, so hopefully one bias balances the other.

That said, its obviously an infringment. The leaf hangs the same direction, the bite has the same proportions to the apple, hell it looks like someone copy/pasted the apple logo and clicked the fill button. I don't think think Apple could lose this case even in a New York court using a public defender.

Most likely they already have an out of court settlement and are just both hoping for a lot of free publicity.

I thought the article description would be sufficient. I pulled this from an ad.

    Attachment 8125

I better avoid taking bites out of apples with a stem and a leaf, Apple may sue me.

Ah, well that logo is obviously NOT an infringment and Apple should be sanctioned for frivolous litigation. I was under the impression that the OP posted the offending logo.

greenNYC... that's funny. Kinda like "greenish" which makes for a rather accurate description.
